TERMS & CONDITIONS  

PLEASE NOTE: We use truck and trailer or horse and trailer combinations for our removals. In the event of poor access for our trucks or long walks (greater than 40 metres) a shuttle service will be required at the client’s cost or a Carry Service is to be charged per hour.

CONDITIONS UPON WHICH PROPERTY IS REMOVED, PACKED OR STORED BY UNISHAUN LOGISTICS CC

Contract conditions upon which property is removed, packed, warehoused or handled by Unishaun Logistics cc. These conditions and/or our quotations can only be changed or amended by our director/s.

This contract explains the rights, responsibilities and obligation of the customer and those of Unishaun Logistics cc. The words ‘you’, or ‘your’ refers to the customer and the words ‘us’ and ‘ours’ refers to Unishaun Logistics cc.

Liabilities for loss or damage is limited. Please pay close attention to Clause 8. Insurance is a separate contract between you and the insurers and the insurance conditions are separate from our contract conditions.

1. OUR QUOTATION

Our quotation is based on information provided by you in relation to terms and requirements.
Our quotation is a fixed price and does not include insurance, customs duties, ad valorem wharfage and any other fees paid to government departments.

We may change the quotation if:

a. You do not accept it within 28 days
b. The work has not been completed within three months if you have caused the delay
c. Our costs go up because of changes in the official rate of exchange
d. Extra goods need to be removed or stored, not included in the quotation
e. We have to collect or deliver above a second floor unless we agreed to do so in writing
f. The stairs, lifts or doorways are inadequate for the movement of goods, or the approach (driveway) is unsuitable for our vehicles
g. UNLESS you have told us in writing of these problems before the preparation of the quotation
h. Extra services are requested after the preparation of the quotation
i. If, due to unforeseen circumstances, additional services are required on site (e.g. shuttle service) the customer is obliged to cover these costs.

In all these circumstances you agree to pay the extra charges.

3. YOUR RESPONSIBILITIES

a. Ensure that nothing is taken away or left behind in error
b. Obtain all documents necessary for the removal at your own expense (in case of international removals?)
c. Take responsibility for the security of your goods at the departure point and the destination point by being present yourself or appointing an individual to represent you
d. Adequately prepare and stabilize appliances and equipment prior to their removal
e. Arrange and pay for any necessary parking facilities if required
f. We will not be held liable for any losses, damages or additional costs that may arise from the above

4. OWNERSHIP OF GOODS

a. The goods to be removed are your own property
b. You have the authority of the owner of the property to undertake this contractual agreement in respect of the goods to be moved or stored

5. EXCLUSIONS

The following items are specifically excluded from this contract:

a. Jewelry, watches, trinkets, precious stones, money, deeds, securities, stamps, coins or goods or collections of a similar kind
b. Potentially dangerous, toxic, damaging or explosive items
c. Goods likely to encourage pests, vermin or cause infestations
d. Refrigerated or frozen goods
e. Animals
f. Keys

We are entitled to dispose of (without notice) any goods submitted which are listed under 5b, 5c and 5d.

6. CANCELLATION

If you cancel or postpone your removal, we may charge a cancellation fee to cover our expenses or losses.

7. TERMS OF PAYMENT

a. To secure a move 50% deposit is required and the balance of the payment needs to be done on the day of loading
b. All payments must be made via EFT
c. You may not withhold any payment based on any claim you may wish to make against us
d. Overdue accounts will incur interest at 2% per month

8.OUR LIABILITY FOR LOSS OR DAMAGE

We will not be liable for loss through burglary or damage resulting from:

a. Fire loss or damage during storage
b. Pest infestation, war, invasion or acts of foreign enemies, wear and tear, leakage or evaporation, atmospheric or climatic changes
c. Death, injury or sickness resulting from the removal or storage of foodstuff
d. Any consequential losses due to delays in transit
e. Any goods not packed or unpacked by us
f. Damage due to items left inside cupboards, fridges, freezers or other furniture
g. Fixtures, fittings, property or goods damaged due to difficult access
h. Goods received from a third party in an unknown condition
i. Any item referred to under Clause 5

9. DISPUTES

a. All claims for loss or damage must be notified to us in writing within 7 days of delivery/collection from us
b. We have the right to withhold goods from delivery until you have paid all our charges or dispose of your goods if you fail to pay our charges :

i. You will be liable for storage charges while we wait for payment
ii. If you do not settle the outstanding amount and remove your goods within the 28 days notice period, we are entitled to sell or dispose of your goods and you will be liable for the cost of sale. The net proceeds will be credited to your account and the surplus, if any, will be paid to you without interest

10. RIGHTS TO SUBCONTRACT

a. We may subcontract some or all of the work to any other organization
b. If we subcontract, this contract will still apply to you and us. In addition, you agree to the Terms and Conditions set forth by the carriers or organization involved in the removal of these conditions will form part of this contract
c. You are liable for any charges, expenses, damages or penalties against us in respect of the goods by a third party unless you can prove that we were negligent
d. You may not defer payments to us or offset any amount due to us in the event of a claim or dispute

11. LEGAL APPLICATION

This contract is entered into at the city or town of origin and is subject to the laws of the country in which this contract was made.

12. STORAGE

a. In case of your goods being stored by us, you must provide a forwarding address and notify us in writing of any changes. All correspondence and notices will be considered to have been received by you seven days after posting it to the last forwarding address recorded
b. All storage charges, including removal charges, must be paid in full before the goods may be taken out of storage
c. We review your storage charges periodically. You will be given 28 days notice of any increases
d. If you wish to end the storage contract, you are expected to give at least 14 working days notice. Charges for storage will be payable to the date when the notice would have ended
e. You will be charged a handling fee, should you make arrangements to collect your goods out of storage
f. If we wish to end your storage contract, you will be given at least three months’ notice
g. Storage is charged on a monthly basis
h. The costs for goods stored with us between the 1st and 15th of every month will incur the full monthly charge. For the remainder of the month fifty percent of the monthly storage cost will apply

13. INSURANCE

a. You are strongly advised to insure your goods against all insurable risks during removals, shipping and storage for their full replacement value at destination
b. Should you wish for us to arrange cover with our insurance company on your behalf, you need to complete and submit the relevant documentation prior to the removal

15. NON INSURANCE :

As small number of our customers prefer not to pay for insurance and, by so doing they agree to accept any liability arising from damage and/or loss of any kind. Unless insurance is arranged by you personally, you will receive no compensation on any claims whatsoever.

As specialists in the removal/relocation business, we understand the issue relating to the possibility of loss or damage to your personal goods. Loss or damage is always outside of your control, and if it should occur it may vary from total loss (an Act of GOD), through various stages of damage such as marking, scratching or breaking. Privately arranged insurance is highly unlikely to give to you to comprehensive cover and peace of mind that you need, and there are usually important exclusions.

The completed application form should be emailed to us and the original supplied before the packing and loading of our household effects begins.

16. EXTRA ITEMS

In order for the shared-load system to work well, and allow us to give you the most competitive price, we have to plan our loads very carefully. We base this planning on the inventory lists supplied by clients when obtaining a quote.

Please note that when collecting we will not be able to add extra items not specified in the inventory, as this disrupts our load plan for the vehicle. Although the vehicle may seem to have plenty of space, we cannot simply take extra items because:

  • There may be several other clients that need to be loaded after you, and if we over-load for you there may not be space for all of their goods. How would you feel if you were the last client being loaded and the vehicle arrived at your home almost full?
  • Our quotation to you is based on the inventory list you supplied. Adding extra items would essentially mean we are expected to transport goods free of charge.

In exceptional cases we may agree to load extra items that are not in the inventory, but a 400% surcharge will apply, i.e. the excess items will be charged at 5x the usual rate.

Any additions or changes to the original inventory list must be sent to us at least 48 hours before collection, to allow us to plan space in the vehicle and re-quote if necessary.

17. COLLECTION AND DELIVERY TIME

Please note that all collection and delivery dates/times are subject to change without notice.

We always do our utmost to keep to collection and delivery schedules. However, due to circumstances beyond our control this is not always possible. As much as we would like to, we cannot absolutely guarantee collection and delivery dates and times.

Loading delays at other clients in the same shared load, unexpected traffic congestion, bad weather and other unpredictable factors can affect our ability to be totally accurate with our scheduling. We will, however, keep you informed about any delays and revised scheduling, and do everything in our power to get back on schedule as soon as possible.
